By accessing and using Dead Bro's Rails Application Performance Monitoring (APM) service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service.

Description of Service

Dead Bro provides Rails application performance monitoring services, including but not limited to:

• Real-time performance monitoring and analytics
• Error tracking and alerting
• Database query performance analysis
• User activity monitoring
• Custom dashboards and reporting
• Integration with third-party services (e.g., Slack)

Account Registration

To use our service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized use

Acceptable Use

You agree to use our service only for lawful purposes and in accordance with these Terms. You may not:

• Use the service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service or servers
• Use the service to monitor applications you do not own or have permission to monitor
• Reverse engineer, decompile, or disassemble our software
• Resell or redistribute our service without permission

Service Availability

We strive to maintain high service availability but cannot guarantee uninterrupted access. We may temporarily suspend service for maintenance, updates, or technical issues. We will provide reasonable notice when possible.

Data and Privacy

Your use of our service is also governed by our Privacy Policy. By using our service, you consent to the collection and use of information as described in our Privacy Policy.

Intellectual Property

The Dead Bro service, including its software, documentation, and all related materials, is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Pricing and Payment

Our service offers multiple pricing tiers:

• Free Tier: Limited to 500,000 requests per month
• Standard: €50/month for up to 10M requests
• Pro: €200/month for up to 50M requests
• Enterprise: Custom pricing for unlimited requests

Paid subscriptions are billed monthly in advance. You may cancel your subscription at any time, but no refunds will be provided for unused portions of the billing period.

Service Level Agreement

We aim to maintain 99.9% uptime for our service. If we fail to meet this standard, Enterprise customers may be eligible for service credits as outlined in their specific SLA.

Limitation of Liability

To the maximum extent permitted by law, Dead Bro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our service.

Indemnification

You agree to indemnify and hold harmless Dead Bro from any claims, damages, or expenses arising from your use of our service or violation of these Terms.

Termination

We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. You may terminate your account at any time by contacting us or using the account deletion feature in your dashboard.

Modifications

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through our service. Continued use of the service after changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to conflict of law principles.
